For centuries, fishing has been one of the main ways for humans to get food. Now industrial fishing uses modern technologies, but also does not forget about old grandfather’s means. In the modern world, the activity of fishermen has become a threat to populations of many species of freshwater fish. As a result, many countries have imposed strict restrictions on gear and catch. The general tendency of these restrictions is a ban on fishing with any nets, a ban on fishing during spawning, and a restriction on space for commercial fishing. All issues are left to the State Agency for Fisheries...
And what kind of “State Agency” is it?
The State Fisheries Agency of Ukraine (SFA) is the central executive body that implements state policy in the field of fisheries and fishing industry, protection, use and reproduction of aquatic bioresources, fisheries regulation, maritime safety of fishing fleet vessels. The State Fisheries Agency includes a fish protection patrol. Note that the fisheries authorities are law enforcement agencies. In Art. 10 of the Law of Ukraine “On Fisheries, Industrial Fisheries and Protection of Aquatic Bioresources” and the Regulations of the Fisheries Patrol specify its powers: to inspect fishing gear, control their number, check compliance with legislation; check documents on the right to use aquatic bioresources, number, floating) and inspect items, vehicles (including floating), fishing gear, harvested products and other items, seize from persons tools for the extraction of aquatic bioresources, vehicles (including floating), equipment and items that were instruments of crime and illegally extracted aquatic bioresources;
to carry out, in cases established by law, photography, sound recording and video recording as aids to prevent and detect violations of legislation in the field of protection, use and reproduction of aquatic bioresources.
To implement measures to protect aquatic bioresources, prevent, detect and stop violations in the field of fisheries, defined by the laws of Ukraine, a fish protection raid is carried out by a raid group of representatives of the State Fisheries Agency with or without other participants in the fishery protection raid. its territorial body, on the terms of conducting fish protection raids.
The official of the raid group, having found a person who may violate the legislation in the field of fisheries, is obliged to: greet, name his name, position, and present at the request of such a person an identity card, giving the opportunity to read the information contained therein, not releasing the ID card from the hands; to state the essence of the committed offense and, if possible, to find out the circumstances that may affect the consideration of materials on administrative offenses; offer to present identity documents (passport, driving license or vehicle) to draw up a report on an administrative offense; to draw up a report on an administrative offense in accordance with the Instruction on registration of materials on administrative offenses by fishery protection bodies, approved by the order of the Ministry of Agrarian Policy and Food of Ukraine of April 9, 2003 № 101.
We provide all these rules in such detail to show that no one is following them, or, at best, only a part of them.
Catch, fish, big and big...
In accordance with the order of the Department of the State Fisheries Agency in Kyiv and Kyiv region dated November 10, 2019 ОД POD-438/2 “On conducting a fish protection raid” created a raid group headed by Chief State Inspector Novak IP
To our opinion, the inspection of registered fishermen was reduced to extortion, as the removal of nets with the appropriate tags and the presence of all permits is a violation of the rules, compliance with which should be carried out by the raid team.
But the State Fisheries Agency does not notice this and is ready to justify any actions of its subordinates. This is the reaction to the relevant appeals of citizens-entrepreneurs (fishermen). It should be understood that the offense committed by a civil servant, in the first place, is a violation of the oath and requires an appropriate inspection, and indulgence in such actions should be considered as corruption of officials. You don’t have to go far for examples.
Maksym Kaminskyi (an employee of the Community of Fishermen of Ukraine), an employee of the Fisheries Patrol Rapid Response Department, organized his own enrichment scheme.
Since the spring of 2019, Kaminsky has been constantly prosecuting independent fishermen for alleged violations, ie defiantly violating the Rules. Maksym Kaminsky seized boats and destroyed nets without a court order, and also created favorable conditions for Oleh Borysenko, a fishing entrepreneur who fished, bought and sold fish.
Kaminsky himself and through inspectors met with fishermen, appointing himself “looking after” the Kyiv region, persuaded fishermen to work through SPD Borisenko OV, that is, to give him all the fish, because he allegedly has enough refrigerators.
Borysenko himself constantly violates the Rules, as evidenced by the materials of the criminal proceedings entered in the Unified Register of pre-trial investigations for № 12019110060000062 from 21.11.2019 (on the grounds of a criminal offense under Part 1 of Article 249 of the Criminal Code of Ukraine “Illegal occupation of fish, animals or other waters fishing ”). The businessman’s property has even been seized, but this does not stop his fishing.
Borisenko was not stopped even by the ban on fishing! Thus, during the spawning period on May 31, 2018, in the river port of the capital, he and his accomplices were detained and as many as 60 (!) Nets were removed from the vein. Significant damage was estimated at more than 47 thousand UAH.
Maksym Kaminskyi, who flaunts a good catch together with the head of the environmental NGO “Zvir” Vitaliy Lyava, does not neglect fishing during the spawning period.
But this is not a separated case of violations of the law, which is committed under the roof of the State Fisheries Agency.
SE “Service”, for example, is engaged in fictitious stocking of reservoirs, and uses funds for this purpose, and is engaged in real scams: money laundering through fictitious stocking received from rents for the use of state ocean-going vessels.
Such a deal would not have prospects for implementation, if not for the criminal conspiracy of the leadership of the State Fisheries Agency and the Kyiv Fish Protection Patrol, which signs acts on stocking in the region.
Sadly. On the one hand, the State Fisheries Agency must take care of the conservation of aquatic fauna, and on the other hand, its employees, who are not clean, level the public’s efforts to restore the natural potential of our lakes and rivers.
Isn’t it time for activists to take part in competitions for appointments, to head the regional structures of the State Fisheries Agency and to stop the mess in the country?
